Terms of Service

Please read these Terms of Service carefully before using our website or engaging our notary services. By contacting us, submitting a form, or scheduling an appointment, you agree to be bound by these terms.

1. About These Terms

These Terms of Service ("Terms") govern your use of the website located at mobilenotary.localservicebiz.com/chatsworth-notary and the professional mobile notary services provided by Ellen Michaels Mobile Notary Public ("Ellen Michaels," "we," "us," or "our"), located at 9909 CA-27 #284, Chatsworth, CA 91311.

By using our website or engaging our services, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms.

2. Description of Services

Ellen Michaels Mobile Notary Public provides professional mobile notary services including but not limited to:

  • Loan signing and real estate document notarization
  • Power of attorney notarization
  • Trust, will, and estate planning document notarization
  • Advance health care directive notarization
  • Hospital, nursing home, and care facility visits
  • Apostille document preparation and authentication assistance
  • Notarization for physicians, pharmacists, and healthcare professionals

All notarial acts are performed in accordance with California Government Code §§ 8200–8230 and all other applicable state and federal laws. We reserve the right to decline any notarization request that we believe is not legally appropriate, involves a questionable document, involves a signer who does not appear to understand what they are signing, or for any other reason permitted by law.

3. Appointments and Scheduling

Booking: Appointments may be scheduled by phone at (818) 425-1126, by email, or through the contact form on our website. An appointment is not confirmed until you receive explicit confirmation from us.

Cancellations: We ask that you provide at least 24 hours' notice if you need to cancel or reschedule an appointment. Last-minute cancellations (less than 2 hours before the scheduled appointment) or no-shows may result in a cancellation fee to cover travel and time costs.

Preparation: You are responsible for ensuring that all documents are complete and ready to sign before the appointment. We do not provide legal advice, prepare documents, or review documents for legal sufficiency. If a document is incomplete or improperly prepared, we may be unable to complete the notarization at that appointment.

Valid ID required: All signers must present a current, unexpired, government-issued photo ID at the time of notarization. Acceptable forms of ID include a California driver's license, California state ID, U.S. passport, U.S. military ID, or other government-issued photo identification. We are required by law to refuse notarization if satisfactory identification cannot be confirmed.

4. Fees and Payment

Notary fees: California law sets the maximum notary fee at $15 per notarized signature (California Government Code § 8211). Our fees comply with this requirement.

Travel fees: A mobile travel fee may apply depending on the distance to your location and time required. Travel fees will be disclosed to you before your appointment is confirmed.

Additional fees: Additional fees may apply for after-hours appointments, rush scheduling, extended wait times, or complex signings involving a large number of documents or signers. All fees will be disclosed in advance.

Payment: Payment is due at the time of service unless otherwise agreed in writing. We accept cash, check, Venmo, Zelle, and other payment methods as communicated at the time of booking.

Refunds: Fees for completed notarizations are non-refundable. If we are unable to complete a notarization due to circumstances within our control, we will not charge for that service.

5. Client Responsibilities

By scheduling an appointment with us, you agree to:

  • Provide accurate and complete information when booking
  • Ensure all signers are present at the scheduled time and location
  • Ensure all signers have valid government-issued photo ID
  • Ensure all documents are complete, filled out, and ready to sign before the appointment
  • Ensure that all signers are signing willingly and are not under duress
  • Not ask the notary to perform any act that is illegal, improper, or in violation of California notary law
  • Provide a safe and accessible location for the appointment

6. Limitation of Services

Not legal advice: Ellen Michaels is a commissioned California Notary Public, not an attorney. Nothing provided by us — verbally, in writing, or on our website — constitutes legal advice. We cannot advise you on whether a document is legally valid, what document you should use, or how a notarized document will be treated by any court, agency, or institution.

Document preparation: We do not prepare, draft, or alter documents. Documents must be brought to us complete and ready for signature.

Legal effect: Notarization does not guarantee that a document will be accepted by any specific institution, court, foreign country, or government agency. You are responsible for ensuring that the document meets all requirements of its intended use.

7. Limitation of Liability

To the fullest extent permitted by California law, Ellen Michaels Mobile Notary Public shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to the use of our website or services, including but not limited to damages arising from errors in notarization, rejection of notarized documents, delays, or any reliance on information provided on our website.

Our total liability to you for any claim arising from our services shall not exceed the total fees paid by you for the specific service giving rise to the claim.

Nothing in these Terms limits our liability for gross negligence, willful misconduct, or fraud.

8. Indemnification

You agree to indemnify and hold harmless Ellen Michaels Mobile Notary Public from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) any inaccurate or incomplete information you provided to us.

9. Website Use

The content on our website — including text, images, logos, and other materials — is owned by or licensed to Ellen Michaels Mobile Notary Public and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content for commercial purposes without our prior written consent.

You agree not to use our website for any unlawful purpose or in any way that could damage, disable, or impair the website or interfere with other users.

10. Third-Party Services

Our website may use third-party tools and services including GoHighLevel for form submissions, Google Maps for location information, and social media platforms. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party service providers.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms or our services shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.

12. Changes to These Terms

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ellen Michaels Mobile Notary Public regarding your use of our website and services, and supersede all prior agreements and understandings.
